Preamble
Leapter GmbH (“Leapter”) provides an AI-powered software service for visualising business logic. The service is currently in an open beta phase (“Open Beta”). These Terms govern the free use of the service during this phase.
§ 1 Scope of Use and Beta Limitations

Beta Status
The service is under active development and may contain defects, outages or data loss.

Free Use & Evaluation Purpose
The service is provided free of charge for testing and evaluation only.
Persistent production use is not intended during the Beta.

Fair Use & Technical Limits
Leapter may apply technical limits (e.g., daily usage caps) and adjust them at any time.

Excessive Use / Abuse
Leapter may restrict or suspend accounts in cases of:-
excessive usage beyond typical evaluation levels,

automated access without an API agreement,
-
load-intensive activity,
-
account sharing or circumvention of limits.

5. Service Modifications
Leapter may modify, add, or remove features at any time
§ 2 AI Disclaimer

Outputs are generated using AI models and may be inaccurate, incomplete or misleading.

Outputs are drafts only and must be manually reviewed.

Users are fully responsible for verifying all results before using them operationally.

Leapter is not liable for damages resulting from unverified AI results.
§ 3 Liability

Free-of-Charge Use
Leapter is liable only for intent and gross negligence for free beta services.

Negligence
Liability for slight negligence is excluded, except for injury to life, body, health or essential contractual duties.

Indirect Damages
Leapter is not liable for lost profits, data loss, or other indirect or consequential damages.

Mandatory Liability
Statutory mandatory liability (e.g., under product liability laws) remains unaffected.
§ 4 Rights to Content

Input
Users retain all rights to their inputs (data, text, prompts).

Output
Leapter grants users all transferable usage rights to generated outputs.
Note: AI-generated content may not be protectable under copyright law.

License for Service Provision
Users grant Leapter a non-exclusive, worldwide licence to process input/output to operate the service.

Third-Party Processing
Users consent to the transfer of input to third-party AI providers (e.g., OpenAI/Google).
Their respective terms apply.

No Training Use by Leapter
Leapter does not use user data to train internal AI models.

Analytics
Leapter may process anonymised usage data for technical optimisation.
§ 5 Data Protection
The Leapter Privacy Policy applies, including details on:

legal bases under GDPR

transfer to third-party providers

retention periods
-
user rights
§ 6 Termination

Leapter may terminate the beta service or individual accounts at any time.

After termination, access to the service may no longer be available.

Leapter is not obliged to store or retain any data after the beta ends.
§ 7 Changes to the Terms
Leapter may update these Terms.
§ 8 Final Provisions

German law applies.

Place of jurisdiction is the registered office of Leapter GmbH (for business users).

If individual provisions are invalid, the remainder remains effective.
